Notice and Procedure for Making Claims of Copyright Infringement
Wigix respects the intellectual property rights of others. If you are a copyright owner or its agent, you may submit a written notification pursuant to Title 17, United States Code, Section 512(c)(2) of the Digital Millennium Copyright Act ("DMCA") of the alleged copyright infringement to our Copyright Administrator with the following information:
- Specific description of work that is allegedly being infringed;
- An identification of where the infringing material is located on the Wigix Website;
- Your name, address, telephone number, and e-mail address;
- A statement by you that you have a good-faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law;
- Include the following statement: "I swear, under penalty of perjury, that the information in the notification is accurate and that I am the copyright owner or am authorized to act on behalf of the owner of an exclusive right that is allegedly infringed", and
- Your signature or the signature of the person authorized acting on behalf of the copyright holder.
Wigix may give notice to its members by means of a general notice on its Website, electronic mail to a member's e-mail address, or written communication sent by first-class mail to a member's physical address in our records. If you receive such a notice but believe that the removed content is not infringing, you may provide a counter-notification in writing to our Copyright Administrator that includes the following information below.
- Your name, address, telephone number, and e-mail address;
- A description of the material removed and its location on Wigix Website before it was removed;
- A statement that you consent to the jurisdiction of Federal District Court for the judicial district in which you reside (or San Francisco, California if your address is outside of the United States);
- A statement that you accept service of process from the notifier of the alleged infringement;
- Include the following: "I swear, under penalty of perjury, that I have a good faith belief that the material identified above was removed or disabled as a result of a mistake or misidentification of the material to be removed or disabled" and
- Your signature.
The notice should be sent by email to customerservice@wigix.com.
If the notice of copyright infringement does not comply with DMCA requirements, our Copyright Administrator will determine, in its sole discretion, if contact with the notifier (assuming this information is available) is needed to investigate the allegation.
If the notice of copyright infringement complies with DMCA requirements, our Copyright Administrator will use the DMCA process to handle the specific allegations of copyright infringements.
