Wigix Storefront policies are established to foster a reliable trading relationship between Sellers and Buyers within a safe and secure environment. These policies are developed and enforced to encourage trust between members and offer a dependable venue to our members who wish to engage in honest and accountable transactions. As a Wigix member, you agree to uphold and abide by the rules and policies set herewith.
a) Seller: Any member who has listed an item for sale and is required to follow through with the delivery of the item to the purchaser once it is sold unless a cancel order is initiated by the seller prior to a buy order being placed on the item.
b) Buyer: Any member who has placed a buy order and is required to pay the agreed amount with 3 calendar days to the seller once the item is bought.
c) Xchange Dealer : This is a special designation awarded (by invitation only) to a Seller who has satisfied all of the following criteria:
The right to sell items through our Storefront service is subject to a monthly subscription fee of $29.99. This monthly subscription may be cancelled at any time without a refund for pro rata use. Wigix reserves the right to offer promotions and upon expiration of any promotion, if cancellation request is not received, your credit card will be charged $29.99 non-refundable monthly subscription fee. Your cancelation of the subscription must be received in writing by email 7 days in advance of next billing cycle and an acknowledgement will be sent to you. In case of non-payment your store account will be suspended in 5 days after the payment due date. If your account is not resolved in 14 days after the suspension date your store will be closed and your store data will be erased from our databases.
The right to use custom URL is subject to a monthly subscription fee of $5.99. You will need to change the DNS settings with your domain name registrar to point to our DNS servers. Your domain name registrar may require up to 48 hours for the new settings to come into effect. Thereafter, please allow 2 to 3 business days for the domain name to be set up at wigix.com after the required changes were made.
In order to reduce online fraud Wigix has the right to request a photocopy of your Driver's License and a photocopy of the front of your credit card in order to verify your identity. You authorize Wigix, directly or through third parties, to make any inquiries we consider necessary to validate your registration and verify your identity. This may include ordering a credit report and performing other credit checks or verifying the information you provide against third party databases.
Because authenticating members on the Internet is difficult, Wigix cannot and does not confirm every member's purported identity. To mitigate this situation, Wigix has constituted a feedback system to help members assess other members based on their ratings given by others in the community. Wigix encourages direct communication amongst its members especially between potential buyers and sellers.
Invoices are sent out to Wigix Sellers on the 1st day of each month. Sellers' credit cards will be charged on the 10th of the month unless payments had been received and posted to the accounts prior to this date. Sellers' transaction fees become due as and when the transaction is closed regardless of payments from their respective buyers.
Fees may be paid by PayPal, Google Check, Credit Cards (Visa, MC), or ACH if available.
Wigix reserves the right to change or discontinue, temporarily or permanently, some or all of its Services at any time with or without notice. In the event Wigix introduces a new service, the fees for that service are effective at the launch of the service. Moreover, Wigix may choose to temporarily lower fees of certain services for promotional events at anytime it chooses. Start dates and end dates would be posted on the Website for clarity. Changing Wigix's Fee Policy and fees to its services is at Wigix' sole discretion and will be disclosed to members through conspicuous postings at the Website. It is the responsibility of the members to check the Website for these changes.
Wigix prohibits the listing or sale of any item that is illegal to sell under any applicable law, statute, ordinance, or regulation, including, but not limited to, items listed in our Prohibited and Restricted Product Categories available at Terms of Use.
You must have the legal authority to sell the goods that you are listing for sale on our Website. You must describe your item and all terms of sale in your listing as accurately as possible. If you accept an offer, you are obligated to complete the transaction with the other party unless (i) the transaction is prohibited by law or this Agreement, or (ii) the buyer materially modifies it. An offer to sell may not be retracted once a buyer had purchased the item. You are also responsible for payment of the transaction fee per the Wigix Fee Schedule in the Terms of Use.
If you make an offer to buy and the offer is accepted (or You use our Buy It feature), you are obligated to complete the transaction with the seller and be bound by the terms and conditions specified by the seller, unless (i) the transaction is prohibited by law or this Agreement, (ii) the seller materially changes the item's description or the item does not conform to the seller's description, or (iii) a typographical error exists in the listing information which materially affects the terms of sale. An offer to buy may be retracted for any reason at any time prior to acceptance by the seller.
You agree that it is the Seller's and the Buyer's responsibility to determine whether sales or use taxes apply to the transactions and to collect, report, and remit the correct tax to the appropriate tax authority. You also agree that Wigix is not obligated to determine whether sales or use taxes apply and is not responsible to collect, report, or remit any sales or use taxes arising from any transaction.
If you download software/applet from the Wigix, the software or applet, including all files and images contained in or generated by the software, and accompanying data (collectively, "Software") are deemed licensed to you by Wigix, for your personal use only. Such download does not transfer either the title or the intellectual property rights to the Software, and Wigix retains full and complete title to the Software as well as all intellectual property rights therein. You shall not sell, redistribute, or reproduce the Software, nor shall you decompile, reverse-engineer, disassemble, or otherwise convert the Software to a human-perceivable form. All trademarks and logos are owned by Wigix or its licensors and you shall not copy or use them in any manner.
Wigix assumes no liability for the content of the listings. The seller shall reimburse Wigix for all losses Wigix may suffer as a result of the listing, unless that loss is due to Wigix's act or omission.
Wigix may investigate reports of abuse or misuse and, if appropriate, limit or prohibit your use of the Website or modify your user profile to reflect its determinations. You agree that Wigix may access your account and records on a case-by-case basis to investigate complaints or allegations of abuse, infringement of third party rights, or other unauthorized use of the Website. Wigix does not intend to disclose the existence or occurrence of such an investigation unless required by law, but Wigix reserves the right to terminate your account or your access to the Website immediately, with or without notice to you, if Wigix believes you have violated any of the Terms of Use, furnished Wigix with false or misleading information, or interfered with use of the Website by others. All determinations are final and are made at Wigix's sole discretion. In agreeing to these Terms, you agree to participate in investigations and be bound by Wigix's determinations. If Wigix, in its sole discretion, determines that a violation of this Agreement has occurred, or if Wigix believes that your actions may cause legal liability for you, our users or us, Wigix may take actions or pursue legal remedies that it believes are necessary or prudent, including, but not limited to, issuing a warning, filing a complaint, deleting any listings, advertisements or offending material from our Website, suspending or canceling your Account, releasing user Information, filing a report with the appropriate authorities and/or excluding any person(s) who may have violated any Terms of this Agreement. Wigix may cooperate with any investigation by any Federal, State, or local body or any court or tribunal. Such cooperation may be with or without notice to you. Wigix will take each reported account into consideration during the investigation process before making a decision.
BY USING WIGIX'S SERVICE OR ACCESSING THE WEBSITE, YOU ACKNOWLEDGE THAT YOU HAVE READ THESE TERMS OF USE AND AGREE TO BE BOUND BY THEM IN ADDITION TO THE TERMS OF USE AND PRIVACY POLICY.
