Wigix
The Sell More, Get More Program ("Program") is open to U.S. and Canada residents who are registered Wigix members in good standing. Individuals without membership in wigix.com are not entitled to any benefits or proceeds arising from the Program. Good standing means a member has fulfilled the requirements for Wigix membership and has neither voluntarily withdrawn nor has been terminated or suspended from membership, and the account is not in delinquency. By participating in the Program, you agree that you meet these eligibility requirements and the Official Rules. However, you are under no obligation to participate or redeem your cash rewards. Employees of Wigix and its related companies as well as the immediate family (spouse, parents, siblings, and children) and household members are not eligible to participate. Violating these and other rules may cause the immediate suspension or cancellation of your account, and void your rights to receive any prizes you may have won. The Program is void where prohibited.
The Program period starts at 12:01 a.m. Pacific time on September 1, 2008 and extends to 11:59 p.m. Pacific time on December 31, 2008.
All items listed for sales with a unit price greater than $25 ("Eligible Items") are eligible to receive rewards. Eligible Items do not include digital goods such as Wigix item pages. For accounting purpose, you earn your rewards as points and each point is worth $0.01. Points are awarded only when the Eligible Items are sold during the Program Period and are calculated based on net sales per month. Net sales means the sales of Eligible Items listed by you on your account minus any returns or refunds and does not include any transaction fees, shipping or handling charges, insurance, and taxes. For example, if an item is sold for $80 (having met the minimum price requirement of greater than $25), the 2% reward equals 160 points or $1.60 (2% of $80) cash.
Maximum point accumulation on net sales earning 2% reward is 10,000 points per Program Period. 10,000 points can be redeemed for a $100 check.
ALL FEDERAL, STATE AND LOCAL TAXES, INSURANCE AND ANY RELATED COSTS ASSOCIATED WITH THE RECEIPT OR USE OF ANY PRIZES ARE THE SOLE RESPONSIBILITY OF THE WINNERS.
If your account is in default (i.e. not in good standing), Wigix reserves the right to prohibit you from earning or redeeming points and to cause you to forfeit any points in your account. If your account is closed for any reason during or after the Program Period, the total balance of your accumulated points will be forfeited. You will also forfeit any unredeemed points if you cancel your Wigix membership. Additionally, any attempt to accumulate points by means of an automated machine or computer, scripts, software computerized or automated process, or through the use of multiple accounts is expressly prohibited. Wigix will cancel a member's account and that member will forfeit all points earned if they are found to be manipulating the system. If your points are forfeited for any reason, Wigix will not reinstate these points to your account.
Points will be awarded and will be redeemed for cash on a first-earned, first redeemed basis. You must request payment through the appropriate mechanism on the Wigix web site. (There is a web page under a member's account options to request payment.) Points earned during the month are not available for redemption until they are posted on your monthly billing statement or on Wigix account. If there is a discrepancy in the Wigix account such as a reward not being credited, then the member must contact accounts-payable@wigix.com within 30 days after the receipt of the billing statement. Failure to do so may result in the forfeiture of the reward points.
Points may be redeemed for bank checks subject to a processing fee of $1.50 per check. Wigix reserves the right, in its sole discretion, to determine the amount of processing fee, to waive the processing fee, or to change the processing fee without notice. Reward checks are issued once a month usually on the last week of every month. The checks are then mailed to the mailing address that the member supplies as part of the payment request process. Wigix is not responsible for lost mail or any other event beyond Wigix's control that would prevent the member from receiving their check. Any bank fees related to returned or cancelled checks due to a contact or payment information error or omission may be deducted from the newly issued payment.
Wigix reserves the right to alter or waive any Program feature or benefit prospectively or retroactively, including, without limitation, reward or point accrual or redemption criteria, or to cancel or temporarily suspend the Program at any time without prior notive.
To learn how the personal information collected in connection with the Program may be used, individuals should read the terms of Wigix Privacy Policy which are incorporated herein by reference.
Members are responsible for maintaining accurate account information at all times, including valid email address information. Members are also responsible for reviewing their account balance on a regular basis and for checking to ensure that all awards have been made properly. Wigix is not responsible for any incorrect or inaccurate information supplied by the member while participating in the Program. All questions or disputes regarding eligibility for the Program, earning of rewards or points, or a member's compliance with these Official Rules will be resolved by Wigix in its sole discretion.
Caution: Any attempt by a member to deliberately damage any Wigix web site or other components or undermine the legitimate operation of the Program is a violation of criminal and civil laws and should such an attempt be made, Wigix reserves the right to seek damages from any such members to the fullest extent permitted by law.
By participating in this Program, you agree to waive any right to claim ambiguity in these Official Rules and release, indemnify, and hold harmless Wigix, Inc. and all of its subsidiaries, affiliates, shareholders, directors, officers, employees, representatives, and agents (collectively "Releasees") from and against any and all liabilities whatsoever and howsoever arise, and waive any and all causes of action, related to any claims, costs, injuries, losses or damages of any kind arising out of or in connection with the Program. This limitation of liability applies to all loses, costs, expenses, and damages of any kind, including (without limitation) compensatory, general, direct, indirect, special, incidental, punitive or consequential damages, loss of data, income or profit.
Members agree that Releasees have not made nor are in any manner responsible or liable for any warranty, representation, condition, or guarantee, whether statutory, express or implied (including, but not limited to, implied warranties of merchantability, merchantable quality, title, and fitness for a particular purpose), in fact or in law relative to the Program. Without limiting the generality of the foregoing, Releasees do not make any express or implied warranties or representations with respect to the Wigix site, and Releasees shall not be liable for the consequences of any interruptions or errors related thereto. Releasees are not responsible for printing or typographical errors in any materials related to the Program.
Except where prohibited, member agrees that: (a) any and all disputes, claims, and causes of action arising out of or connected with the Program shall be resolved individually without resort to any form of class action and exclusively by arbitration under the Commercial Arbitration Rules of the American Arbitration Association; (b) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred (i.e., only costs associated with participating in the Program), but shall not include attorneys fees under any circumstances; and (c) member hereby waives all rights to claim punitive, incidental, and consequential damages.
If any provision of these Official Rules is found to be invalid or unenforceable by a court of competent jurisdiction, such provision shall be severed from the remainder of these Official Rules, which will otherwise remain in full force and effect.
